Terms of Service

The short version SafeLease gives you an AI-assisted opinion on visible rental hazards from the photos you upload — it's a decision aid, not a legal inspection certificate. Reports are accurate to the best of our ability but have limits. You pay through Razorpay. If something goes wrong with a report, email us and we'll make it right per our Refund Policy.

1. Who these terms apply to

These Terms of Service ("Terms") are a legally binding agreement between you ("you", "your", "the user") and SafeLease, a sole proprietorship operated by Pratik Limbachiya from Surat, Gujarat, India ("SafeLease", "we", "us", "our"). By using safelease.in, joining the waitlist, or purchasing a report, you agree to be bound by these Terms. If you do not agree, please do not use the service.

These Terms are published in accordance with Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

2. What SafeLease is — and what it is not

SafeLease is an AI-assisted advisory service. You send us property details and photos; we return a hazard report that highlights visible issues — damp, mould, cracks, pest evidence, exposed wiring, and similar concerns a renter should know about before signing.

SafeLease is not:

  • A licensed building inspection or structural engineering service
  • A legally-admissible court document or survey report
  • A substitute for a professional inspection where one is legally required (such as for sale deeds, stamp duty, or insurance claims)
  • A guarantee that no hidden defects exist — we can only report on what's visible in your photos or on-site visit
  • A party to the rental agreement between you and your landlord

3. Eligibility

You must be at least 18 years old and legally capable of entering a contract under the Indian Contract Act, 1872. By using SafeLease, you confirm that you meet these criteria.

Prices listed on the website at the time of purchase are what you pay. We may change prices at any time for future orders; changes do not apply retroactively. Goods and Services Tax (GST) will apply if and when we cross the threshold for mandatory registration under the CGST Act, 2017 (currently ₹20 lakh annual turnover for services). Until then, no GST is charged.

5. How the service works

  1. You join the waitlist or place an order on safelease.in.
  2. You upload photos and provide property details (address, rent, locality).
  3. You pay through Razorpay — we never see your full card or UPI credentials.
  4. We analyse your submission using AI and human review, then deliver a written report to your email.
  5. For the Inspector Visit tier, we schedule a site visit and deliver the report afterwards.

6. Payments

All payments are processed by Razorpay Software Private Limited, an RBI-authorised payment aggregator. By paying through Razorpay, you also agree to Razorpay's terms and privacy policy, available at razorpay.com/terms. Razorpay accepts UPI, credit cards, debit cards, net banking, and major wallets.

A tax invoice will be sent to your email after successful payment. If payment fails, no order is created; any amount deducted will be auto-reversed by your bank or Razorpay, typically within 5–7 business days, per RBI guidelines.

7. Refunds and cancellation

Our refund and cancellation terms are covered in detail in our separate Refund & Cancellation Policy. In short: if your report is significantly incorrect or not delivered, email us within 7 days and we will re-do the report or refund you. Refunds are processed through Razorpay to your original payment method within 7 business days of approval.

8. Your responsibilities

When you use SafeLease, you agree that:

  • You have the legal right to photograph the property and share the photos with us — for example, you're an intending tenant given access by the landlord, broker, or agent.
  • You will not upload photos of people without their consent or photos of documents containing personal data you don't own.
  • The information you provide (address, rent, description) is accurate to the best of your knowledge.
  • You will not use SafeLease to harass, defame, or extort any landlord, broker, or third party.
  • You will not attempt to reverse-engineer, resell, or repackage our reports as your own service.
  • You will not use our service in any way that violates Indian law, including but not limited to the Information Technology Act, 2000 and its amendments.

9. Intellectual property

The SafeLease brand, logo, website content, methodology, and report templates are owned by the proprietor and protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You get a personal, non-commercial, non-transferable license to use the report you purchase — for your own decision-making, for showing to your landlord, or as supporting material in a consumer forum complaint.

You retain ownership of the photos you upload. By uploading, you grant us a limited license to process them solely to generate your report and for internal quality review. We do not use your photos for marketing without your separate written consent.

10. Accuracy and limitations

We aim for accurate, useful reports, but the AI cannot detect hidden issues like structural decay behind walls, moisture inside electrical systems, or defects not visible in your photos. Your report is only as good as the photos and information you provide. We recommend you also:

  • Visit the property in person before signing any agreement
  • Get a professional inspection for any property with significant red flags
  • Read your rental agreement carefully, especially clauses on deposits, maintenance, and repairs

11. Limitation of liability

To the maximum extent permitted under Indian law, SafeLease's total liability to you for any claim arising out of or connected to your use of the service — whether in contract, tort, or otherwise — is limited to the amount you paid us for the report in question, or ₹1,499, whichever is lower.

We are not liable for:

  • Losses arising from you relying on the report beyond its intended scope (as described in Section 2)
  • Disputes between you and your landlord, broker, or housing society
  • Property damage, theft, or harm that occurs after you occupy the premises
  • Delays, outages, or errors caused by third-party services (Razorpay, Cloudflare, Formspree, AI providers)
  • Indirect, consequential, or incidental losses — including lost rent, lost deposit, or emotional distress

Nothing in these Terms limits liability that cannot be limited under Indian law — for example, liability for our own fraud or gross negligence, or statutory consumer rights under the Consumer Protection Act, 2019.

12. Third-party services

We rely on third parties to deliver our service: Razorpay for payments, Formspree for form submissions, Cloudflare for hosting, and AI providers (such as OpenAI or Anthropic) for analysis. Their terms and privacy policies apply alongside ours. Any outage or failure on their end is outside our direct control, though we will make reasonable efforts to switch providers or resolve issues promptly.

13. Termination

You can stop using SafeLease at any time by not placing further orders. You can request deletion of your account data by emailing us (see Section 17).

We may suspend or terminate access to any user who violates these Terms, commits fraud, or abuses the service. Where possible, we will notify you first and offer a chance to fix the issue.

14. Changes to the service and these Terms

SafeLease is an early-stage service. We may change features, pricing, or turnaround times as we learn what works. Material changes to these Terms will be posted here with an updated "Last updated" date. If we have your email, we will notify you at least 15 days before any material change takes effect for purchases made after that date.

15. Force majeure

We are not liable for failures or delays caused by events outside our reasonable control — including natural disasters, government action, internet or power outages, strikes, or pandemics. If such an event prevents us from delivering your report, we will refund your payment in full.

16. Governing law and dispute resolution

These Terms are governed by the laws of India. Any dispute will first be attempted to be resolved through good-faith discussion by email for at least 30 days. If not resolved, the dispute is subject to the exclusive jurisdiction of the courts of Surat, Gujarat.

As an Indian consumer, you retain all rights under the Consumer Protection Act, 2019, including the right to file complaints with the District Consumer Disputes Redressal Commission where you reside.

These Terms are written in plain English. If any clause conflicts with Indian law (IT Act 2000, DPDPA 2023, Consumer Protection Act 2019, Indian Contract Act 1872), the statute prevails and the rest of these Terms remain in force.
